These Terms of Service ("Terms") govern your use of StudyEdge AI ("the Service"), operated by StudyEdge AI ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use StudyEdge AI.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must provide a valid email address to create an account. You may not share your account with others or create accounts for others without their consent.
You may only create one account. Creating multiple accounts to circumvent plan limits is not permitted and may result in termination of all associated accounts.
You agree not to use StudyEdge AI to:
StudyEdge AI uses artificial intelligence to generate study schedules, session plans, flashcards, quizzes, and study coach advice. You acknowledge and agree that:
StudyEdge AI offers a free plan and paid subscription plans (Pro and Unlimited). Paid plans are billed on a weekly, monthly, or annual basis depending on the option you select.
All billing is handled by Stripe, Inc., our payment processor. By subscribing, you also agree to Stripe's Terms of Service. Your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date.
Prices are listed in USD. Applicable taxes may be added depending on your location. We reserve the right to change pricing with at least 14 days' advance notice to subscribers.
Pro plans include a 3-day free trial for new subscribers. The trial is processed through Stripe Checkout and requires a valid credit or debit card. If you do not cancel before the trial ends, your card will be automatically charged the applicable subscription price. The free plan is always available with no credit card required.
Refunds are available within 7 days of your first payment on a new subscription only. Once a free trial has ended and your card has been charged, that charge is non-refundable. Subscription renewal charges are non-refundable. To request a refund on an eligible initial charge, contact us at support@getstudyedge.com within 7 days of the charge. Refunds will not be granted outside this window except where required by applicable law (including EU/EEA consumer cooling-off rights where applicable).
The free plan is subject to usage limits including a maximum number of courses and AI queries per day or month. We reserve the right to adjust free plan limits with reasonable notice. If you exceed plan limits, you will be prompted to upgrade.
You can cancel your subscription at any time through your account settings or by contacting us at support@getstudyedge.com. Upon cancellation, you will retain access to paid plan features until the end of your current billing period. After that, your account will revert to the free plan. Your data will remain accessible unless you choose to delete your account.
We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or misuse the Service. If we terminate your account without cause, we will issue a prorated refund for any unused portion of a paid subscription period. You may terminate your account at any time by deleting it through the app settings.
StudyEdge AI and its underlying technology, design, and branding are owned by StudyEdge AI and are protected by applicable intellectual property laws. The content you create inside the app (your study plans, notes, courses, and session data) belongs to you. We do not claim ownership over your personal study content.
By submitting content to the Service (such as course descriptions and notes), you grant us a limited, non-exclusive license to use that content solely to provide and operate the Service for you.
You may upload notes, syllabi, PDFs, and other content to the Service ("User Content") to power AI features. You represent that you have the right to submit such content and that doing so does not infringe the intellectual property rights of any third party. StudyEdge AI processes User Content solely to provide the requested feature (summarization, flashcard generation, event extraction, etc.) and does not claim ownership over it.
StudyEdge AI respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on or accessible through the Service infringes your copyright, please send a written notification containing: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement of good faith belief; and (e) a statement of accuracy under penalty of perjury, to: support@getstudyedge.com (Attn: DMCA Notice). We will process valid notices in accordance with the DMCA.
StudyEdge AI is a study productivity and planning tool designed to help you organize your studying, understand course material, and practice for exams. You are solely responsible for ensuring that your use of the Service complies with your institution's academic integrity policies. StudyEdge AI does not submit work on your behalf, and you may not use the Service to engage in academic dishonesty, including submitting AI-generated content as your own original work in violation of your institution's rules. We are not liable for any academic disciplinary consequences arising from your use of the Service.
You agree to indemnify, defend, and hold harmless StudyEdge AI and its operators, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUDYEDGE AI IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO ACADEMIC OUTCOMES, DATA LOSS, OR SERVICE INTERRUPTIONS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES, OR THAT ANY SPECIFIC ACADEMIC OUTCOMES WILL RESULT FROM USING STUDYEDGE AI.
These Terms are governed by the laws of Canada, without regard to conflict of law principles. If you are located in the European Union or United Kingdom, mandatory consumer protection laws of your jurisdiction may also apply and are not waived by these Terms.
Before initiating arbitration or any legal proceeding, you agree to first contact us at support@getstudyedge.com and give us 30 days to attempt to resolve your concern informally. Most concerns can be resolved this way. If we are unable to resolve your concern within 30 days, either party may proceed to binding arbitration as described below.
PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights.
You and StudyEdge AI agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including the validity of this arbitration clause) will be resolved by binding individual arbitration rather than in court, except that either party may bring a claim in small claims court if it qualifies.
Arbitration will be conducted under the rules of a recognized arbitration body (such as JAMS or equivalent) in the province of Ontario, Canada, or remotely if both parties agree. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
This arbitration clause does not apply to: (a) claims for injunctive or other equitable relief to protect intellectual property rights; or (b) users located in the European Union or United Kingdom, who retain their statutory rights to bring disputes before competent courts.
YOU AND STUDYEDGE AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If a court or arbitrator decides this class action waiver is unenforceable, the arbitration clause in Section 16 will be deemed inapplicable.
This waiver does not apply to users in jurisdictions where class action waivers are not permitted by law.
We may update these Terms from time to time. When we do, we will update the "Last updated" date. If changes are material, we will notify you by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
